These terms are the agreement between you and The KELO Group LLC, which operates High Desert Crime Tracker ("HDCT", "we", "us"). By using the site, creating an account, or subscribing, you agree to them. If you don't agree, please don't use the site. Our Privacy Policy explains how we handle your information.
HDCT presents publicly available dispatch information from the San Bernardino County Sheriff's Department and the California Highway Patrol in plain language, with maps, analytics, and optional email alerts. We are an independent local publisher. We are not affiliated with, endorsed by, or acting for any law enforcement agency.
Alerts are sent by email for calls near an address you choose, within the distance you set (up to 3 miles). They are a convenience provided on a best-effort basis. Alerts can be late, missing, or inaccurate because of source delays, location estimates, or email delivery problems. We don't guarantee that you'll be notified of any event.
You agree not to:
The site's design, text, plain-language descriptions, graphics, and software belong to us or our licensors. The underlying dispatch records come from public sources. While you have an account in good standing, we give you a personal, non-exclusive, non-transferable license to use HDCT for your own purposes under these terms. Nothing here transfers ownership of anything to you.
Local businesses can advertise on HDCT. Advertisers' purchases are subject to the pricing and terms presented when they buy and to any separate agreement with us. We don't endorse advertisers or their products, and ads don't influence the information we publish.
HDCT relies on other services, including Stripe (payments), Mailgun (email), Google (maps, address lookup, fonts), and our hosting provider. We're not responsible for their services, and their own terms apply to your use of them.
You can stop using HDCT or cancel at any time. We may suspend or end your account if you break these terms, misuse the site, or if we're required to by law. If we end your account because of your violation, we're not required to refund fees already paid.
HDCT is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the site will be uninterrupted or error-free.
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, or for any harm that results from relying on information, reports, or alerts from HDCT. Our total liability for any claim relating to the site or these terms is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you haven't paid us anything. Some places don't allow certain limits, so parts of this section may not apply to you.
If your misuse of HDCT, or your breach of these terms, leads to a claim against us, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
We may update these terms. When the changes matter, we'll post the new version here with an updated date and, for subscribers, notify you by email. If you keep using HDCT after a change takes effect, you accept the new terms.
These terms are governed by California law, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in San Bernardino County, California, and you and we consent to those courts' jurisdiction.
